HON'BLE SRI JUSTI CE C. PRAVEEN KUMAR WRIT PETITION No. 37367 of 2018 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the second respondent in not renewing the 2-B Bar Licence for the year 2018-19 to the petitioner's bar M/ s. Tara Classic A/ c Restaurant and Bar in spite of collection of renewal application fee of Rs.1,00,000/ - vide challan No.25767 dated 15.09.2018 through State Bank of India, Warangal Branch and also renewal fee of Rs.14,70,000/ - dated 15.09.2018, vide challan No.25772 as illegal, arbitrary and against the principles of natural justice.

2) Though various grounds are raised, learned counsel for the petitioner restricts his prayer seeking a direction to the second respondent to pass orders on the reply, dated 28.09.2018 given by the petitioner to the notice dated 24.09.2018, at the earliest.

3) The Government Pleader for Prohibition and Excise, would submit that if no orders are passed as on today, a direction may be given to the authorities to pass appropriate orders after hearing all the concerned.

4) Recording the statements made, the Writ Petition is disposed of, directing the second respondents to pass orders on the reply dated 28.09.2018 given by the petitioner to the notice dated 24.09.2018, after hearing the petitioner and the owner of the premises ie., fourth respondent herein, in accordance with law, as early as possible, preferably, within a period of three to four weeks from the date of receipt of a copy of the order.

5) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
