HON'BLE SRI JUSTICE SURESH KUMAR KAIT CIVIL REVISION PETITION No.5163 of 2016 ORDER : (Oral) Despite the opportunities granted, notice is not served upon the respondent. On two consecutive dates, petition was adjourned at the request of the counsel for petitioner. It is pertinent to mention that vide order dated 23.11.2016, interim stay was granted in favour of the petitioner. In such eventuality, the petitioner is duty-bound to make efforts to serve the respondent. However, neither the respondent is served nor there is appearance on behalf of the petitioner. 2.

It seems the petitioner is no more interested in prosecuting the present petition.

The petition is dismissed in default and for non-prosecution as well. No costs. Pending miscellaneous applications, if any, shall stand closed.
