THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 7820 of 2015 ORDER:

This Criminal Petition is filed against the orders of the II Additional Sessions Judge, Nalgonda at Suryapet in Criminal Revision Petition No.35 of 2014 dt.10.06.2015, wherein and whereby the Sessions court confirmed the maintenance awarded by the Trial Court in M.C.No.19 of 2013 dt.31.05.2014. 2.

This Court by order 07.09.2015 granted interim stay of the impugned order dt.10.06.2015 on condition of the petitioner continues to pay monthly maintenance of Rs.4,000/- to the 2nd respondent and Rs.2,000/- to the 3rd respondent, pending disposal of the criminal petition and also directed the petitioner to pay the entire arrears as directed by the Court below. 3.

The main ground raised by the petitioner is that though there was no harassment of any kind, false allegations are made and he is staying separately. Further, though notice was issued to the 2nd respondent on 02.07.2012, asking her to join the petitioner, the 2nd respondent failed to join, for which reason she cannot be granted maintenance.

The order passed by the learned Sessions Judge does not warrant any interference since the same is based on reasons. 5.

Learned Counsel for the petitioner submits that till date all the arrears have been paid and he continues to pay total amount of Rs.6,000/-, as directed by this Court on 07.09.2015. 6.

In the present facts and circumstances of the case, keeping in view the costs involved in living, this Court deems it appropriate to direct the petitioner to pay an amount of Rs.6,000/- to the 2nd respondent and Rs.4,000/- to the 3rd respondent, in all Rs.10,000/- every month. The petitioner shall pay the said maintenance from September, 2022.

Accordingly, the Criminal Petition is disposed off and the petitioner is directed to pay an amount of Rs.6,000/- to the 2nd respondent and Rs.4,000/- to the 3rd respondent towards maintenance from September, 2022 onwards.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
