THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.37215 of 2018 ORDER:

Heard learned Counsel for the petitioner, the learned Government Pleader for Excise appearing for respondents No.1 and 2 and the learned Government Pleader for Home appearing for 3rd respondent.

It is stated by the Counsel on both sides that the issue raised in this Writ Petition is covered by Order, dated 20.12.2017, in W.P.No.43388 of 2017.

Therefore, for reasons alike, this Writ Petition is also disposed of, directing the petitioner to make an appropriate application before the Deputy Commissioner of Prohibition and Excise, Nalgonda (2nd respondent herein) enclosing thereto a Fixed Deposit Receipt for Rs.17,600/- (Rupees seventeen thousand and six hundred only) drawn in favour of the 2nd respondent on any nationalized bank; and on such application being made by the petitioner, the subject stock i.e., 1760 kgs., of black jaggery in FIR No.82 of 2018 on the file of the 3rd respondent, shall be given to the interim custody of the petitioner. There shall be no order as to costs.
