HON'BLE SRI JUSTICE R. KANTHA RAO Contempt Case No.2114 of 2014 ORDER:

Heard Sri G. Venkateswarlu, learned counsel appearing for the petitioner and Sri M.Sudheer Kumar, learned counsel appearing for the respondents.

2. This court in WP MP No.25120 of 2014 in WP No.20029 of 2014 dated 27.10.2014 passed the following order: "There shall be interim direction to the respondents to pay the salary to the petitioner, due, if any, within six (6) weeks from today."

This contempt case is filed alleging that the above mentioned order passed by this court has not been complied with. In response thereto, the respondents-filed counter-affidavit stating that after receipt of the order passed by this court in WP MP No.25120 of 2014 dated 27.10.2015, the 2nd respondent called for the salary payment particulars of the petitioner and verified the same. On verification, it was noticed that an amount of Rs.30,402/- was due to the petitioner towards his salary till the month of June, 2014. When the same was offered to him in person, the petitioner refused to receive the same. Thereafter, a cheque for Rs.30,402/- was sent by registered post with acknowledgment due on 24.09.2014 to the residential address of the petitioner and the details of the said salary were also furnished.

But for the reasons best known to the petitioner, he did not choose to encash the said cheque. It is further stated that as per the directions of this court, an amount of Rs.30,402/- was credited directly to the salary account of the petitioner on 12.11.2014 and a detailed order was passed in Proceedings dated 12.11.2014 in compliance with the order dated 27.10.2014 passed by this court. The petitioner refused to receive the said proceedings, though he was present in the College.

petitioner by registered post with acknowledgment due. Nextly, it is submitted that the salary due to the petitioner from the month of July 2014 onwards is also being paid along with all other staff members by duly crediting the same to the bank account of the petitioner.

3. In view of the detailed counter-affidavit filed by the respondents stating that the order of this court has been complied with, it cannot be said that they are guilty of any disobedience in respect of the order passed by this court on 27.10.2014.
