HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.45168 of 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is preferred by the petitioners seeking to declare the inaction of the 3rd respondent in implementing the orders of the 2nd respondent in D.Dis.F1/4638/2014 dated 02.09.2014, as illegal and arbitrary.

Heard the learned counsel for the petitioners and the learned AGP for Revenue for respondents. With their consent, the Writ Petition is disposed of at the stage of admission itself. Though various grounds are raised in the writ petition, the learned counsel for the petitioners restricts his prayer seeking a direction to the 3rd respondent to dispose of the representation submitted by the 2nd petitioner on 17.10.2016, at the earliest. Learned AGP would submit that the 3rd respondent may be directed to dispose of the representation, if the order of the 2nd respondent is still in force.

Having regard to the rival submissions made, the Writ Petition is disposed of directing the 3rd respondent to deal with the representation dated 17.10.2016 made by the 2nd petitioner herein seeking implementation of the order of the 2nd respondent and dispose of the same, if not already disposed of and if the order of the 2nd respondent is not stayed, suspended or challenged before any other higher authority, in accordance with law, as early as possible, preferably within a period of 4-6 weeks from the date of receipt of a copy of this order.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. No order as to costs. ______________________________ JUSTICE C. PRAVEEN KUMAR 26.12.2016 sur
