Heard learned counsel for the petitioner as well as the learned standing counsel appearing for the respondents. The petitioner is working as Anganwadi Helper at Nandikotkur Anganwadi Center and she claims that there is a vacancy of Anganwadi Worker and she is eligible for promotion to the said post, whereas the said promotion was not granted to the petitioner. Learned standing counsel appearing for the respondents, on written instructions from the third respondent, submits that the post of Anganwadi Worker was filled up long ago, however the incumbent was unauthorisedly absent from duty and there was no vacancy at present, as claimed by the petitioner.
The aforesaid statement is not disputed by the learned counsel for the petitioner, However the learned counsel for the petitioner submits that the Anganwadi Worker was unauthorisedly absent from duty for four years and so far no action has been taken.
Leaving it open to the competent authority to take action for the unauthorized absence, this writ petition is disposed of directing the respondents to consider the claim of the petitioner for the post of Anganwadi Worker as and when vacancy arises.
