THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3424 OF 2016 ORDER:

This petition is filed by the petitioner under Section 482 Cr.P.C. seeking to quash the proceedings against him in FIR No.937 of 2015 on the file of the Panjagutta Police Station, Hyderabad, registered for the offence punishable under Sections 420, 448 and 506 IPC. Heard and perused the material available on record. It is alleged that the petitioner and his father made the 2nd respondent to believe them and received an amount of Rs.1,80,00,000/-, promising to repay the same with interest. They executed promissory notes in favour of the 2nd respondent. When the 2nd respondent asked to return his amount, the petitioner gave a cheque for Rs.50 lakhs and the said cheque was dishonoured. On 30.11.2015, while the 2nd respondent was in the house of his friend, the petitioner along with some other goondas trespassed into the house and threatened him.

Learned Counsel for the petitioner submitted that the petitioner filed a suit against the petitioner and his father for recovery of amount and the same is pending and that the allegations are civil in nature. The trust or otherwise of the allegations is necessarily to be investigated into by the investigating agency. Therefore, this Court is not inclined to interfere with the proceedings in the above crime. If any charge sheet is filed against the petitioner and if the petitioner is aggrieved over the same, he is at liberty to seek appropriate remedy. Accordingly, the Criminal Petition is dismissed. Consequently, miscellaneous petitions pending, if any, shall stand dismissed. ______________________ JUSTICE RAJA ELANGO Date : 15.3.2016 Nn
