HON'BLE SRI JUSTICE R.SUBHASH REDDY AND HON'BLE SRI JUSTICE A.SHANKAR NARAYANA WRIT PETITION No.29721 of 2015 ORDER : (Per Hon'ble Sri Justice R.Subhash Reddy) This writ petition is filed seeking a direction by way of Mandamus to direct the 1st respondent to consider the case of the petitioner for admission into MBBS/BDS Courses for the academic year 2015-16 against the quota earmarked for Physically Handicapped.

The petitioner has placed on record the copy of notification for counseling for admission into MBBS/BDS Courses for the academic year 2015-16 in the State of Andhra Pradesh, issued by the 1st respondent University. With regard to physically handicapped quota, the notification reads as under:

"As per the regulations of MCI, the Physically Challenged candidates with locomotor disorder of lower limbs between 40% to 70% are only eligible. Candidates are informed to appear for medical examination before the medical board constituted by the Competent Authority for confirmation of eligibility for admission under PH category. Other disability candidates need not attend the verification."

It is the case of the petitioner that she has disability of more than 40%, but from a perusal of the disability certificate produced by the petitioner, it is clear that the disability is to her

upper arm, but not to any lower limb, so as to fit into the eligibility criteria notified by the 1st respondent University. In that view of the matter, no direction as prayed for can be granted and the writ petition is accordingly dismissed. No order as to costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
