THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE P.KESHAVA RAO W.P.No.37603 OF 2018 ORDER:

(Per Sanjay Kumar, J) Challenge in this Writ Petition was to the sale notice dated 31.8.2018 issued by the Debts Recovery Tribunal-2, Hyderabad, in relation to the petitioners' property pursuant to the Recovery Certificate issued in O.A.No.3 of 2011.

The sale was to be held on 12.10.2018. However Sri G. Kalyan Chakravarthy, learned counsel for the petitioners, would inform this Court that the sale did not materialize on the said date for want of bidders. In that view of the matter, we find no surviving cause to adjudicate this Writ Petition on merits.

The Writ Petition is accordingly dismissed on this short ground, leaving it open to the petitioners to raise all issues, if warranted, in future in an appropriate proceeding.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
