ORDER:

Petitioners are not satisfied with the compensation determined and are seeking enhancement of the compensation by referring to Arbitrator under Section 3-G (5) of the National Highways Act, 1996. Alleging inaction in referring the matter to Arbitrator, this Writ Petition is filed. Learned Government Pleader asserts, on instructions, that no such representation is received by the District Collector-cum-Arbitrator/1st respondent.

Learned counsel for the petitioners submits that the petitioners have sent representation dated 25.04.2018 to 1st respondent by registered post with acknowledgment due. As it is stated by the learned counsel for the petitioners that petitioners have sent a representation dated 25.04.2018 to 1st respondent, if any such representation is received by the 1st respondent, the 1st respondent shall consider the request of the petitioners for reference to Arbitration for enhancement of compensation and the decision shall be communicated to the petitioners within six weeks from the date of receipt of this order.

Writ Petition is accordingly disposed of. No order as to costs.

As sequel to it, Miscellaneous Petitions, if any pending, shall stand dismissed.
