THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.39634 of 2016 ORDER:

Heard Smt.K.V.Rajasree for petitioner and Assistant Government Pleader for Civil Supplies for respondents. On 20.09.2016, the petitioner applied for dealership of fair price shop No.32 (48032) in Koduru Village, Rowthulapudi Mandal, East Godavari District in terms of G.O.Ms.No.4, Consumer Affairs, Food and Civil Supplies (CS-I) Department, dated 28.02.2014. The respondents have issued notification for appointment of a dealer on permanent basis vide Ref.No.A/310/2016, dated 12.09.2016. The grievance of petitioner is, G.O.Ms.No.4, dated 28.02.2014, provides for consideration of dependant of a deceased fair price shop dealer for appointment and without considering such entitlement, if permanent arrangement is made, the petitioner stands to lose. Hence, the writ petition.

The Assistant Government Pleader for Civil Supplies submits that respondent No.3-Revenue Divisional Officer, Peddapuram Division is under obligation to consider the claim of petitioner in accordance with the G.O. referred to above and to avoid uncertainty in the matter, he submits that appropriate direction can be issued to respondent No.3 to consider and dispose of application, dated

20.09.2016, in accordance with the extant rules and policy of the Government.

The statement is placed on record and the writ petition is disposed of by this order:

(a) Respondent No.3 to pass orders on the application, dated 20.09.2016, within four weeks from the date of receipt of copy of this order;

(b) The petitioner is given liberty to communicate the order copy within one week from today;

(c) Till a decision as directed by this order is taken and communicated or subject to such decision, the permanent arrangement sought to be made through notification, dated 12.09.2016, can be considered. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. _____________ S. V. BHATT, J Dt:17.11.2016.
