This criminal petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/A.1 seeking his enlargement on bail in connection with Crime No.599 of 2025 of Armoor Police Station, Nizamabad District. The offences alleged against the petitioner are under Sections 7 of Essential Commodities Act, Sections 318(4), 111 r/w.3(5) of Bharatiya Nyaya Sanhita (2023).

The case of the prosecution is that on 08.11.2025 the Deputy Tahsildar (CS) Armoor lodged a report before police

- 2 - stating that he received a request from SHO Armoor informing that on 07.11.2025 their team caught a vehicle bearing No.TS 07 UF 6840 at weekly Bazar near Balaji Function Hall, Armoor Town in which they are illegally transporting PDS rice which was purchased from the dealer. As such, requested the police for taking necessary action against the accused, basing on which case was registered against the accused for the above offences.

Heard Sri Alluri Divakar Reddy, learned counsel for the petitioner and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.

The contention of learned counsel for the petitioner is that petitioner is innocent of the said allegations and he is in jail from 10.11.2025 and that the material part of investigation is already completed. He also submitted that there are two cases pending against the petitioner and in the said cases, the allegation is that petitioner purchased the rice from card holder which is not an offence. As such requested this Court to grant bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail on the ground that petitioner is a habitual offender and earlier two charge sheets are filed against him. If he is released on bail, he will commit the similar offence. As such, petitioner is not entitled for bail and prayed this Court to dismiss this petition.

Considering the submissions made and the material on record, petitioner is in jail from 10.11.2025 and Lws.1 to 6 are examined including the investigating authority.

However considering the period of incarceration of petitioner in jail and the progress in investigation, this Court deems it fit to grant bail to the petitioner subject to the following conditions: i.

The petitioner/A.1 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of Principal Judicial First Class Magistrate at Armoor.

ii.

The petitioner/A.1 shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.

iii.

The petitioner/A.1 shall abide by the conditions stipulated in Section 483(2) of BNSS.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
