HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 37697 of 2018 ORDER:

1) Heard learned counsel for the petitioner and Government Pleader for Revenue. With the consent of both the parties, the writ petition is heard at the admission stage itself. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the inaction of respondent No.4 in conducting inquiry pursuant to the orders of the 3rd respondentRevenue Divisional Officer in R.C.No. E/ 215/ 2018, dated 25.01.2018 in respect of the lands belonging to the petitioner, in Survey Nos. 14, 52, 64, 109, 119, 156, 162, 175 and 177/ 1, admeasuring Ac.13-83, 70, 15-70, 11-94, 3-98, 4-92, 2-16, 8-72 and 4-00 cents respectively, situated in Pedavarimadugu Village, Pedacherla Palle Mandal, Prakasam district, and in submitting a report to the 3rd respondent, even after lapse of nine months, as illegal, arbitrary and unconstitutional.

3) The main grievance of the petitioner is that inspite of an order passed by the Revenue Divisional Officer on 25.01.2018, directing the Tahsildar to complete the inquiry and send a report in respect of the subj ect lands, till date, no enquiry has been conducted and no report is sent to the Revenue Divisional Officer. 4) The Government Pleader for Revenue would submit that if no report is submitted on the orders passed by the Revenue

Divisional Officer, till date, the Tahsildar concerned may be directed to send the report at the earliest.

5) Having regard to the above, the writ petition is disposed of at the admission stage, directing the Tahsildar concerned to comply with the order passed by the Revenue Divisional Officer, in R.C.No. E/ 215/ 2018, dated 25.01.2018, in respect of the lands belonging to the petitioner, in Survey Nos. 14, 52, 64, 109, 119, 156, 162, 175 and 177/ 1, admeasuring Ac.13-83, 70, 15-70, 11-94, 3-98, 4-92, 2-16, 8-72 and 4-00 cents respectively, situated in Pedavarimadugu Village, Pedacherla Palle Mandal, Prakasam district, as early as possible, preferably, within a period of two to three months from the date of receipt of a copy of the order.
