THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.3247 of 2013 ORDER:

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not paying the summer vacation salary to the petitioner, as illegal and arbitrary and contrary to the decision of the Hon'ble Supreme Court of India in Contempt Petition (C) Nos.80-81 and 93-94 of 2002 in C.A.No.1030-1031 of 1998.

The present writ petition was at first listed before this Court on 05.02.2013. As there was no representation on behalf of the petitioner, who is appearing in person, the matter was directed to be listed on 14.02.2013. On 14.02.2013, the matter was adjourned to 18.02.2013. Thereafter, the docket order dated 26.02.2013 shows that as the party-in-person was not present, the matter was adjourned by two weeks. Again the matter was listed on 17.04.2017. As there was no representation, the matter was directed to be listed today by printing the name of the petitioner, who is appearing in person, in the cause list. Today, also there is no representation on behalf of the petitioner, who is appearing in person.

It appears that the petitioner is not interested in pursuing the Writ Petition.

As there is no appearance on behalf of the petitioner right from the date of filing of the writ petition, the Writ Petition is dismissed for non-prosecution. No order as to costs.

CPK, J W.P.No.3247 of 2013 As a sequel, miscellaneous petitions pending, if any, shall stand closed.
