THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10087 of 2015 ORDER:

This Criminal Petition is filed by the petitioner - accused No.1, under Section 438 of the Code of Criminal Procedure, seeking to grant bail in CC No.511 of 2015 on the file of XIII Additional Chief Metropolitan Magistrate, Hyderabad, arising out of Crime No.37 of 2015 of Women Police Station, D.D., Hyderabad, registered for the offences punishable under Sections 498-A and 406 IPC and 4 & 6 of the Dowry Prohibition Act.

Heard and perused the material available on record. The wife of the petitioner lodged a complaint against the petitioner and his family members alleging the offences under Sections 498-A and 406 IPC and 4 & 6 of the Dowry Prohibition Act. After completion of the investigation, the police filed charge sheet and the case was numbered as CC No.511 of 2015. Learned counsel for the petitioner submitted that the petitioner is now in USA and that NBW was pending against him and that he is intending to appear before the Court below to face the trial as well as the other legal proceedings and hence, he may be granted anticipatory bail.

Considering the said facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioner.

In the circumstances, the Station House Officer concerned is directed to release the petitioner - A1, in the event of his arrest, on his execution of a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for the like sum to the satisfaction of the SHO concerned. Further, the petitioner is directed to appear before the Court concerned regularly. Accordingly, the Criminal Petition is allowed. ______________
