THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION NO.10016 of 2016 ORDER :

The petitioner, who is the sole accused in Crime No.261 of 2016 of S.R.Nagar Police Station, filed the present application under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with the above crime, registered for the offences punishable under Sections 420 and 506 IPC.

The allegations in the first information report would show that the petitioner herein collected a sum of Rs.5,300/- each from the informant and 32 others promising to provide Mudra Loan. After payment of money, when they asked for the loan, the petitioner is alleged to have threatened them with dire consequences. Basing on these allegations the above case came to be registered. Heard learned counsel for the petitioner and Public Prosecutor appearing for the respondent-State.

Learned counsel for the petitioner mainly submits that the allegations made in the report are all false and invented against the petitioner at the instance of his landlord as he filed a civil suit against him. But the same is strongly opposed by the learned Public Prosecutor stating that the suit filed by the petitioner against his landlord is nothing to do with the present crime. A perusal of the material placed before the Court would show that the petitioner has collected an amount of Rs.5,300/- each from 33 persons with a promise to provide mudra loan and when they asked for return of the same, he threatened them with dire consequences. Since the offences alleged against the petitioner are serious and grave in nature constituting an offence punishable under

Section 420 IPC, I am not inclined to grant anticipatory bail to the petitioner.
