ORDER
This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused No.4 in Crime No.702 of before the
Abdullapurmet Police Station, Rachakonda Commissionerate, registered for the offences punishable under Sections 420, 467, 468, 471 r/w 34 of the BNS.

The brief facts of the case are that, on 07.10.2025, the de-facto complainant lodged a report before the police stating that the complainant has two daughters and her husband purchased land on 30.07.2010 to an extent of 1.20 vide Document No.4572 of 2010 total extent of 3 Acres and the same was illegally registered in the name of one Janga Srinivasa Reddy by one Ramakonda Raju with forged documents and used a forged Aadhaar card by showing himself as the son of Anjaneya Raju and actually he is the son of one M. Siva Ramam Raju and the deceased has no sons and the de-facto complainant and her daughters were shown as died with a fabricated document. Hence, she requested for necessary action. Basing on the said complaint, the police registered a case for the above said offences against accused Nos.1 to 5.

Heard Sri Achyuth Bharthwaj, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner is no way connected with the said allegations, neither the petitioner signed as the witness to the fabricated document nor he intended any forged document to be used for cheating the complainant and he is only witness to the said property which was purchased by the husband of the de-facto complainant and without any allegations, the petitioner is falsely implicated in this case and prayed the Court to grant pre-arrest bail to the petitioner by allowing this criminal petition. 5.
On the other hand, learned Additional Public Prosecutor opposed the submissions made by learned counsel for petitioner, on the ground that there are specific allegations against the petitioner and therefore, he is not entitled for the anticipatory bail and the petitioner is the
relative of the de-facto complainant, therefore, he along with other accused fabricated the document and there is a threat from the petitioner to the de-facto complainant and prayed the Court to dismiss the Criminal Petition. 6.
In the light of the submissions made by both the learned counsel and on a perusal of the material available on record, the allegations against the petitioner are that he signed the document through which the de-facto complainant's husband purchased the property as a witness and he along with other accused fabricated the document, whereas, the document filed by the petitioner is fabricated document and he is not arrayed as party or witness. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioner/accused No.4, subject to the following conditions:
i.
The petitioner shall surrender before the Station House Officer, Abdullapurmet Police Station, Rachakonda Commissionerate,
within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/-, with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and cooperate with the Investigating Officer in investigating the case and not to threaten the de-facto complainant.
iii.
The petitioner shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required 7.
Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
