THE HON'BLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE No.2703 OF 2018 ORDER:
This Contempt Case was instituted alleging willful disobedience to the order dated 11.07.2014 passed in Writ Petition No.7258 of 2014. By the said order, the respondents in the Writ Petition were directed to consider the petitioner's request for assignment in terms of the proposals and pass appropriate orders expeditiously.
The counter filed by the District Collector, Warangal Urban, reflects that pursuant to the aforestated order, the applications of the petitioner and others were considered and by proceedings dated 13.3.2015, the District Collector, Warangal, opined that it was not possible to consider the request of the 52 beneficiaries to allot them house sites in the land in Sy.Nos.175 and 176 of Gundlasingaram Village, hamlet of Kumarpally, Hanamkonda Mandal, Warangal District, as it was reserved for public purposes. The District Collector further stated that the proposals of the Tahsildar, Hanamkonda, for allotment of land for providing house sites to the 52 beneficiaries could not be considered at present and that the request would be considered in a suitable location in terms of the orders of the Government.
A copy of the proceedings dated 13.3.2015 is placed on record. In the light of the aforestated proceedings issued by the District Collector, Warangal, there is no possibility to infer any disobedience, much less willful disobedience, to the order passed in Writ Petition No.7258 of 2014, warranting exercise of contempt jurisdiction. In the event the petitioner is aggrieved by the aforestated proceedings dated 13.3.2015, it
is for her to take appropriate steps for seeking redressal thereof by way of independent proceedings in accordance with law The Contempt Case is accordingly dismissed. No order as to costs. ----------------------- SANJAY KUMAR, J.
