ORDER

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused No.17 in Crime No.39 of 2017 before the Bellampalli -

I (Town) Police Station, Mancherial District, registered for the offences punishable under Sections 420, 406 and 120(b) of IPC and Section 5 of APPDFEA.

The brief facts of the case are that Crime was registered at PS Bellampalli-I Town alleging that Aegis Parivar Cooperative Society, through its C&MD, managers, staff, and appointed agents, collected daily and monthly deposits from about depositors amounting to approximately Rs.15,00,000/- and thereafter failed to repay the maturity amounts. The complainant alleged that when he approached the branch for his dues, he was threatened and informed that the matter would end up like the Agri Gold case. Based on these allegations, the petitioner, arrayed as accused No.17, were shown as agents involved in collection of deposits. 3.

Heard Sri N. Harinath, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner was innocent depositor and had no role in the

management or functioning of the society, and that he was falsely shown as agent without any documentary proof of appointment. He further submitted that the investigation had remained pending for eight years without completion, and that no recovery was required from the petitioner as the case was entirely documentary in nature. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this Criminal Petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations leveled against the petitioners are serious in nature. Further, the huge amount was involved in this case and there are number of victims. Therefore, at this stage, granting of pre-arrest bail to the petitioner does not arise. Hence, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon a perusal of the material available on record, it appears that the offences alleged against the petitioner are under Sections 420, 406 and 120(b) of the IPC and Section 5 of the APPDFEA. The learned Additional Public

Prosecutor contends that the petitioner is the private employee and therefore their custodial interrogation is necessary. Further, the crime pertains to the year 2017 and the material part of the investigation has already been completed. Considering the facts and circumstances of the case, this Court deems it appropriate to grant pre-arrest bail to the petitioner, subject to the following conditions: i.

The petitioner shall surrender before the Station House Officer, BellampalliI Town Police Station, Mancherial District, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/-, with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge

sheet and thereafter, as and when required 7.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
