HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.12831 of 2013 ORDER:

In this petition filed under Section Cr.P.C, the petitioner/accused seeks to stay the proceedings in C.C. No. 276 of 2013 on the file of II Metropolitan Magistrate, L.B.Nagar, which was registered for the offence under Section 138 of Negotiable Instruments Act, 1881. 2.

When the matter came up for hearing, learned Public Prosecutor produced the letter dated 13.06.2018 of Sub-Inspector of Police, L.B.Nagar Police Station, Rachakonda Commissionerate and submitted that the case ended in acquittal on 22.1.2016 and therefore, the petition which is filed to stay the proceedings in C.C No. 276 of 2013 has become infructuous and hence the same may be dismissed. 3.

In view of the above submission of learned Public Prosecutor, the Criminal Petition is dismissed as Infructuous. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
