This criminal petition is filed under Section 482 Cr.P.C. questioning the order dated 25.08.2018 in Crl.M.P.No.661 of 2018 in Crime No.145 of 2018 passed by the Judicial Magistrate of First Class (Special Mobile), Karimnagar dismissing the petition filed under Section 219 of Criminal Rules of Practice for return of the passport, on various grounds more particularly apprehending that the petitioner did not mention the details of date of expiry etc.

Learned counsel for the petitioner submitted that the passport may be returned as the same is likely to be expired on 09.11.2018 and to get the benefits from the employer at Dubai and that the petitioner undertakes to appear before the investigating agency immediately after return from Dubai. Having heard learned counsel for the petitioner and learned Public Prosecutor, I find that it is a fit case to direct the Magistrate to release the passport.

In the result, the criminal petition is allowed directing the Judicial Magistrate of First Class (Special Mobile), Karimnagar to release the passport so as to enable the petitioner to saddle to Dubai and return to India within two months from today subject to executing bond for Rs.2,00,000/-(rupees two lakhs only) with two sureties for a like sum to the satisfaction of the Magistrate. After return to India, the petitioner is directed to report before the Magistrate.

Pending miscellaneous petitions in the petition, if any, shall stand closed.
