HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioner is working as Anganwadi Helper (Aaya) in Ambedkar Colony, Marturu village, Prakasam district. Petitioner is seeking promotion/appointment as Anganwadi Worker as in service candidate. Without considering the claim of the petitioner, notification was issued on 09.09.2015 calling for applications from open

market. Though petitioner has also applied on 28.09.2015 for consideration of promotion, but same is not considered. Aggrieved thereby this writ petition is filed.

2. On the issue of entitlement of Anganwadi Helper for appointment as in service candidate as Anganwadi worker, this Court rendered judgment in W.P.No.31374 of 2015 and batch dated 16.11.2015. In terms of the decision of this Court in the above batch of writ petitions, service candidate is entitled for consideration for promotion/appointment to the post of Anganwadi Worker within the village in which she is working.

3. Learned Assistant Government Pleader, on instructions, states that in fact, the Child Development Project Officer (5th respondent) sent a proposal for grant of promotion in favour of the petitioner and the same is pending.

4. Having regard to the decision of this Court in W.P.No.31374 of 2015 and batch dated 16.11.2015, since petitioner is entitled to be considered for promotion, the notification dated 09.09.2015 to the extent of this village is declared as illegal and respondents are directed to consider the claim of the petitioner for appointment/ promotion as Anganwadi Worker as in service candidate working as Anganwadi helper subject to her suitability and eligibility as expeditiously as possible, preferably within a period of four weeks.

4. Accordingly the writ petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ___________________________ JUSTICE P. NAVEEN RAO kkm
