THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.37418 OF 2018 ORDER :
Heard learned counsel for the petitioner and the learned Government Pleader for Home, apart from perusing the entire material on record.
When the matter is taken up, written instructions, furnished by the Sub Inspector of Police, Medipally Police Station, Rachakonda, are placed on record by the learned Government Pleader. The said instructions, to the extent of their relevance to the present Writ Petition, read as under:
"It is submitted that, the Petitioner viz.. Nampally Aruna filed this Writ Petition on 10.10.2018 declaring the action of the 2nd respondent in not receiving the petitioner written complaint dated 7.10.2018 and not registering the FIR, against the respondents 3 and 4 and not causing arrest of them in interfering with the peaceful possession and enjoyment of the petitioner property i.e.. Plot No.179, situated at RTC Colony. Chenigcherla village, Ghatkesar Mandal, Rangareddy District admeasuring 120 sq yards G+2 with pent house as illegal. arbitrary, unjust against the provisions of criminal jurisprudence and also against the Article 300 A Constitution of India and consequently direct the 2nd respondent to receive the petitioner written complaint dated 7.10.2013 and register FIR against the respondents 3 to 5 by cause arrest of thorn in interfering with the peaceful possession and enjoyment of the petitioner property i.e Plot No.179, situated at RTC Colony, Chtnigcherla village, Ghatkesar Mandal,!
Rangareddy District admeasuring 120 sq. yards, G+2 with pent house and pass such other order or orders as the Hon'ble Court may deem it just and proper in the circumstances of the case.
It is submitted that the writ petitioner did not approach before the Station House Officer, Medipally P.S, Rachakonda Commissionerat and did not file any
complaint as alleged in the Writ Petition it is further submitted that, no complaint as alleged in the Writ Petition was received through post also.
It is submitted that if any complaint received from the writ petitioner by the Station House Officer, Medipally P.S., the Station House Officer, Medipally P.S. will act according to procedure".
By placing on record the above written instructions, Writ Petition is disposed of. However, it is open for the petitioner herein to lodge a complaint before the respondents, for consideration in accordance with law. There shall be no order as to costs.
