THE HON'BLE SRI JUSTICE RAGHVENDRA SINGH CHAUHAN AND THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION NO.6130 OF 2018 ORDER: {Per the Hon'ble Sri Justice M.Satyanarayana Murthy} This revision, under Section 115 of the Code of Civil Procedure, is filed questioning the order dated 28.08.2018 passed by the Sub-Divisional Magistrate, Mobile Court, Bhadrachalam in E.P.No.26 of 2018 in Arb.No.219 of 2015, whereby the Court ordered attachment of salary under the A.P. Agency Rules, 1924.

The impugned order is questioned only on the ground that the Agent to Government at Bhadrachalam i.e. the SubDivisional Magistrate, Mobile Court, Bhadrachalam, has no jurisdiction since the place where the petitioner is working is included in East Godavari District, which is part of the State of Andhra Pradesh and erstwhile part of the State of Telangana.

In view of the objection raised by Sri Srinivasa Kondaparthi, learned counsel for the petitioner, Sri Maheswara Rao Kuncheam, learned counsel for the respondents, seeks liberty to file fresh Execution Petition before the Special Agent to Government at East Godavari District, State of Andhra Pradesh.

Granting liberty as prayed for, the Civil Revision Petition is allowed and the order dated 28.08.2018 passed by the

Sub-Divisional Magistrate, Mobile Court, Bhadrachalam in E.P.No.26 of 2018 in Arb.No.219 of 2015 is set aside. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
