HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No:36341 OF 2016 ORDER:

The present writ petition is filed by the petitioners seeking to quash the proceedings against them in Crime No.553 of 2016 on the file of Pet Basheerabad Police Station, Cyberabad.

It is stated in the affidavit that the 5th respondent filed a complaint against the petitioners for the offence under Sections 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act. It is the case of the petitioners that there were matrimonial disputes between the 5th respondent and the 1st petitioner and that the father of the 1st petitioner made several negotiations to settle the issue. But his attempts failed. Hence, the 1st petitioner filed a divorce case against the 5th respondent and after receiving summons, the 5th respondent filed the present complaint. 3.

The petitioners are challenging the investigation in the above crime. This Court is not inclined to interfere with the investigation in the above crime. However, considering the fact that the present complaint has arisen out of matrimonial disputes, this Court is of the view that the investigation can be completed without arresting the petitioners. 4.

Accordingly, respondents No.2 to 4 are directed to complete the investigation and file a report in the above crime, in accordance with law in either way, without arresting the petitioners. 5.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ____________________ JUSTICE RAJA ELANGO Dated: 27th October, 2016 Nn.
