HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 37271 of 2018 ORDER:

1) Heard learned counsel for the petitioners and learned Government Pleader for revenue. With the consent of both parties, the writ petition is disposed of at the admission stage.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent Nos.1 to 4 in attempting to demolish the fence enclosing plot No.37, admeasuring 555 square yards, situated in Survey No.133 at Namana Beauty Bowers, Narsingi village, Gandipet mandal, Rajendranagar division, Rangareddy district, without any notice or intimation under the guise of demarcating adjacent Government land situated in Survey No.134, as illegal and arbitrary.

3) Though various grounds are raised, learned counsel for the petitioners would submit that their representation dated 26.09.2018, seeking survey of the land may be considered, in accordance with law. According to him, though his plot is in Survey No.133, but the authorities are trying to claim the same as in Survey No.134, which is a Government land.

4) Learned Government Pleader for revenue would submit that Survey No.134 being a Government land, question of conducting survey would not arise.

5) Be that as it may, having regard to the facts and circumstances of the case, the writ petition is disposed of directing the petitioners to make a fresh F-Line application, seeking survey of the land, which they intend to, within a week from today, in which event, the Tahsildar concerned shall examine the same and pass orders in accordance with law and as per the circulars issued by the Government from time to time, as early as possible, preferably within a period of two to three weeks from the date of submission of the F-Line application.
