THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.567 of 2015 ORDER:

The petitioner, who is the sole accused in Crime No.219 of 2014 of Podalakur Police Station, SPSR Nellore District, filed the present petition under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with the above crime registered for the offences punishable under Sections 354-A, 506 IPC and Section 7 r/w 8 of Protection of Children from Sexual Offences Act, 2012. The averments in the report discloses that on 08-12-2014 when the informant was attending to her agricultural work, the accused is alleged to have caught hold of her hand and pulled her forcibly behind a tree, kissed her, squeezed her breast and tried to remove her dress. Basing on these allegations, the above report came to be lodged. Heard learned counsel for the petitioner and learned Public Prosecutor representing the State.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated due to political rivalry. He submits that his father is bed-ridden and suffering with many ailments. He being the only son, his presence is necessary to assist his father in his day to day activities. He also submits that he has to attend work of his mother in selling the agricultural produce.

Learned Public Prosecutor opposed the application contending that the allegations made in the report are serious in nature and as such, he is not entitled for the relief sought for. A perusal of the averments in the report disclose that the informant is a minor as on the date of offence and as the averments prima facie constitute the offences alleged against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. However, the

petitioner, if so, advised shall appear before the concerned Court and make an application along with the documents showing ill-health of his father for grant of bail after giving notice to the Public Prosecutor, in which event, the Court concerned shall deal with the same at the earliest and in accordance with law.

Accordingly, the Criminal Petition is disposed of. As a sequel thereto, Miscellaneous Petitions, if any, pending shall stand closed.
