Heard learned counsel for the petitioner and Sri N.
Vasudeva Reddy, learned Standing counsel for the respondent.

By the order impugned punishment of deferment of increment for one year was imposed against the petitioner. A reading of the order would show that there is no discussion on the charge leveled against the petitioner, findings recorded by the Enquiry Officer and the explanation offered by the petitioner, but straight away punishment is imposed. When order passed by the Managing Director is in exercise of power of disciplinary action, minimum that is expected is to contain reasons in support of the decision. Thus, on this ground alone the order is liable to be set aside.

Having regard to the nature of order passed, learned Standing counsel, on instructions would also submit that the order is not sustainable.

Accordingly, the order impugned is set aside remitting the matter to the disciplinary authority from the stage of consideration of the report of the Enquiry Officer and the explanation submitted by the petitioner.
