HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 37330 of 2018 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the third respondent in not disposing of the appeal No.B/ 695/ 2018, dated 19.05.2018 filed under Section 5-B of the R.O.R.Act as illegal, arbitrary and against the principles of natural justice.

2) Though various grounds are raised in the writ petition, the grievance of the petitioner is that though the appeal was filed on 19.05.2018, till date no orders are passed either in the appeal or in the stay application filed along with the appeal.

3) The Government Pleader for Revenue (TG) would submit that a direction may be issued to the concerned for an early disposal of the stay application.

4) Without going into the merits of the case and having regard to the submissions made, the present writ petition is disposed of, directing the third respondent to pass orders in the stay application filed along with the appeal, in accordance with law, after hearing all the concerned, preferably, within a period of four weeks from the date of

receipt of a copy of the order. There shall be no order as to costs.

4) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
