THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.27046 OF 2015 ORDER:

The petitioner was appointed as Fair Price Shop dealer of Shop No.10 of Kandukur Town (Urban) and Mandal, Prakasam District. While so, on 15-09-2014, the Food Inspector inspected the shop of the petitioner and noticed some irregularities. Based on the same, Section 6-A proceedings under the Essential Commodities Act were initiated against the petitioner. In respect of the same inspection, 3rd respondent issued a show cause notice, dated 17-09-2014. The petitioner submitted her explanation on 21-09-2014. After considering the explanation, an order of cancellation of authorization was passed on 25-10-2014, against which, the petitioner preferred an appeal on 12-08-2015 before the 2nd respondent. The petitioner filed the appeal with an application to condone the delay in preferring the appeal. When the said application was not disposed of, the present writ petition is filed.

2. In view of pendency of the appeal before the 2nd respondent with the application to condone the delay in preferring the appeal, this Court is not inclined to examine the merits of the case. Therefore, the 2nd respondent is directed to consider the application for condonation of delay and pass appropriate orders thereon within a period of one month from the date of receipt of a copy of this order.

3. Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
