THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.3217 of 2002 O R D E R:
This Writ Petition is filed seeking a writ of Mandamus declaring the action of the respondents in making a person with postgraduate qualification ineligible to take part in the common entrance test conducted for Telugu Pandit/ Urdu Pandit as arbitrary, illegal and declare that the petitioner is eligible and entitled to participate in entrance test to be conducted for Urdu Pandit training and undergo one year Urdu Pandit training course on the basis of his selection with qualification of M.A. (Urdu) possessed by him.
After filing of the writ petition, an amendment application was filed in WPMP.No.21459 of 2002 seeking to declare G.O.Ms.No.60 Education (SC.TRG.II) Department, dated 4.9.1999 insofar as it prescribes Urdu as medium of instruction at degree level when a person with Urdu at P.G. level tries to compete for the selection test for admission to Urdu Pandit as arbitrary and illegal. The same was ordered on 17.9.2002.
Heard Sri M.Balasubrahmanyam, counsel for the petitioner and the learned Government Pleader for School Education for the respondents.
When the mater is taken up for hearing, it is submitted by the learned Government Pleader that interim directions were granted in
this writ petition on 20.2.2002 directing the 3rd respondent to receive the application of the petitioner for Urdu Pandit training common entrance test scheduled to be conducted in February, 2002 and permit the petitioner to take part in the common entrance test, pending further orders. Since entrance test was already conducted in the year 2002 and the petitioner was permitted to take part in the said entrance test, the cause in the writ petition does not survive. This Court having considered the submissions made by the learned Government Pleader is of the considered view that the writ petition has become infructuous as the petitioner was permitted to take part in the entrance test in the year 2002 and his eligibility and selection to the post of Urdu Pandit will be based on his performance in the said entrance test which was conducted way back in the year 2002.
Accordingly, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.
