Heard learned counsel for the petitioner and learned Government Pleader for respondents.
2. The present writ petition is filed by Sri Priyanka Raw & Boiled Rice Mill, represented by its Managing Partner. The petitioner has been in the business of custom milling of paddy of the Civil Supplies Corporation since 10.03.2015. The Civil Supplies Corporation officials along with Enforcement Officers inspected the rice mill on 14.08.2015 and seized some PDS rice. For release of the said rice, the petitioner filed a petition on 19.08.2015 before the third respondent, but the third respondent appears to have taken up the petition filed by the owner of the lorry and passed an order on 22.08.2015 releasing the lorry without considering the application of the petitioner. In those circumstances, the present writ petition is filed.

The learned counsel for the petitioner submits that the impugned order dated 22.08.2015 for release of the lorry indicates that the seized stock was directed to be disposed of by distributing the same to the cardholders in the month of September, 2015, in which event, the petitioner would suffer serious loss.
He further submits that the petitioner is willing to furnish security for the release of the stock.

In the circumstances, the third respondent is directed to consider the application of the petitioner dated 19.08.2015 for release of the seized stock pursuant to inspection of the petitioner's rice mill conducted on 14.08.2015 and pass appropriate orders in accordance with law within a period of one week from the date of receipt of a copy of this order. In the meanwhile, the order passed by the third respondent dated 22.08.2015 directing the fifth respondent to distribute the seized stock to the
cardholders shall stand suspended.

The writ petition is, accordingly, disposed of. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
