HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.37161 of 2012 ORDER:

1. The petitioner was given Arms licence No.618/ Narayanaguda, covered by one 0.32 bore pistol No.7103 and one 12 bore DBBL Gun No.H977, by the orders of the Commissioner of Police, Hyderabad, on 04.01.2001, which was valid up to 31.12.2010. While so, the petitioner alleges that a false case was registered in Crime No.143 of2008 on the file of Begumpet Police Station, Hyderabad, and in pursuance of the same, a show cause notice was issued to the petitioner for cancellation of the licence. The petitioner submitted his explanation. But, without considering his explanation in proper perspective, the Commissioner of Police, Hyderabad, ordered for cancellation of the licence. Pursuant to the memo issued by the police, the petitioner deposited the weapons with Narayanaguda police. Thereafter, the case in Crime No.

143 of 2008 ended in acquittal in S.C.No.33 of 2010. Challenging the order of cancellation of the licence, the petitioner preferred an appeal before the 1st respondent on 08.10.2012 and when the same is not disposed of in spite of his acquittal and other circumstances, the present writ petition was filed.

In view of the pendency of the appeal before the 1st respondent, this Court is not inclined to go into the merits of the case, but, however, directs the 1st respondent to dispose of the appeal pending before him challenging the order of the Commissioner of Police, Hyderabad, dated 29.09.2008 in accordance with law, within a period of three months from the date of receipt of a copy of this order.

The Writ Petition is accordingly disposed of. No order as to costs.

4. Miscellaneous petitions, if any, pending shall stand closed. ______________________________
