Heard the learned counsel for petitioners and the learned Government Pleader for Home (AP) for respondents. 2.
This writ petition was filed challenging the action of the respondents in opening and continuing rowdy sheet against the petitioners in Galiveedu Police Station, Y.S.R. Kadapa District.
3. Though a counter-affidavit was filed in the year 2012 stating that four cases were filed against the petitioners, and out of them, two cases ended in acquittal and two cases were bound over and no fresh cases were registered against the petitioners, this Court called for fresh instructions in the matter.
Pursuant to the same, the learned Government Pleader, on the basis of written instructions, submits that the bound over period of the petitioners was also expired long back and it is not clear whether any rowdy sheet is being continued or not.
4. Since the petitioners are not involved in any crime and no crime is pending against them, the rowdy sheet opened against the petitioners in the year 2009 shall be closed forthwith. However, this will not prevent the respondents from opening a rowdy sheet against the petitioners, if the Andhra Pradesh Police Manual enables them to do so.
5. The writ petition is, accordingly, allowed. No order as to costs. Miscellaneous Petitions, if any pending, shall stand closed. ______________________________ A.RAMALINGESWARA RAO, J Date: 29.02.2016 TJMR
