HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 37386 of 2018 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the second respondent in not disposing of the stay petition filed in Appeal No.D/ 4202/ 2018 or appeal as arbitrary and illegal. 2) Though various grounds are raised in the writ petition, the grievance of the petitioner is that though the appeal was filed on 28.06.2018, till date no orders are passed either in the appeal or in the stay application filed along with the appeal. 3) The Government Pleader for Revenue (TG) would submit that a direction may be issued to the concerned for an early disposal of the appeal.

4) Without going into the merits of the case and having regard to the submissions made, the present writ petition is disposed of, directing the second respondent to dispose of the appeal No.4202/ 2018 filed by the petitioner, after hearing all the concerned including the petitioner, in accordance with law, as expeditiously as possible, preferably, within a period of six (06) months from the date of receipt of a copy of the order. However, if there is an application for stay, the same shall be dealt with in accordance with law, preferably, within a period of four weeks from the date of receipt of a copy of the order. There shall be no order as to costs.

5) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
