THE HON'BLE SRI JUSTICE S.RAVI KUMAR TRANSFER C.M.P.NO.545 OF 2015 ORDER:

This petition is filed to withdraw O.P.No.1597 of 2014 from the file of Additional Family Court, Hyderabad and transfer the same to Family Court, Visakhapatnam.

Respondent in O.P.No.1597 of 2014 filed this petition contending that the respondent herein is not his wife and his real wife is one Rama Lakshmi whom he married in the year 1985 and the O.P. is filed only to harass him. He further stated that due to election politics, O.P. is filed before Additional Family Court, Hyderabad and that the respondent herein is a resident of Anakapalle, Visakhapatnam District. He further stated that the O.P. before Additional Family Court, Hyderabad is filed with all fabricated documents and both petitioner and respondent are residents of Visakhapatnam District, therefore O.P. before Additional Family Court, Hyderabad has to be transferred to Family Court, Visakhapatnam.

Respondent, in spite of granting time did not file any counter. Since 16.02.2016 as many as six adjournments have been granted to file her counter.

Today, when the matter is called, neither advocate for respondent is present nor any representation is made on her behalf. Heard advocate for petitioner. He submitted that as per the Aadhar Card filed along with this transfer petition, respondent herein is a resident of Raja Street, Thummapala, Anakapalle Mandal and the O.P. is filed before Additional Family Court, Hyderabad only in order to harass the petitioner herein. Considering the reason stated in the affidavit and also considering the documents filed along with transfer petition, O.P.No.1597 of 2014 is withdrawn from Additional Family Court, Hyderabad and transferred to Family Court, Visakhapatnam for disposal in accordance with law.

Petition is ordered, accordingly. Miscellaneous petitions, if any,

pending shall stand dismissed.
