HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO C.R.P. No.5230 OF 2016 ORDER:

The Civil Revision Petition is filed against the order dated 09.09.2016 passed in I.A. No.596 of 2016 in O.S. No.692 of 2010 on the file of XIII Additional Chief Judge (FTC), City Civil Court, Hyderabad.

2) Heard both sides and perused the impugned order of the lower Court.

3) The affidavit of I.A. No.596 of 2016 when supported by reasons given by advocate of the situation that was prevailing in practically preventing to adduce evidence, it is the duty of the Court to consider irrespective of boycott by advocates is prohibited. Thereby this Court feels it just to set-aside the impugned order of the lower Court dated 09.09.2016.

4) Accordingly and in the result, the revision is allowed by setting aside the order of the lower Court dated 09.09.2016 and the lower Court is directed to permit the defendant to adduce evidence on its side with evidence of defendant's representative and another witness by name Neelesh C.Sanghi, which is within one (1) month from the date of receipt of copy of this order, to complete the defendant's evidence. No order as to costs. 5) Consequently, pending miscellaneous petitions, if any, shall stand dismissed.
