Heard counsel for the petitioners and the Government Pleader for Revenue appearing for the respondents.
2. Petitioners' grievance is that they are the owners of the subject lands; that they presented document No.P-78/2015 dt.29.07.2015 for the purpose of registration to the 5th respondent, but the 5th respondent is not releasing the registered document to the petitioners.
3. The Government Pleader for Revenue appearing for respondents states that the 5th respondent will consider the above document for the purpose of registration and if he does not wish to register it, he will pass orders under Section 71 of the Registration Act, 1908 (for short 'the Act') giving reasons why he does not wish to register the said document.
4. In view of the said submission, the Writ Petition is disposed of directing the 5th respondent to consider the above document presented by the petitioners for the purpose of registration and if he does not wish to register it, he shall pass orders under Section 71 of the Act giving reasons why he does not wish to register the said document within a period of four (04) weeks thereafter and communicate his decision thereon to the petitioner. There shall be no order as to costs.
5. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
