THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5129 OF 2015 ORDER:

This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner/A.3 seeking to grant bail in connection with F.I.R. No.17 of 2012 on the file of the P.S., Raikal, Karimnagar District, registered for the offence under Section 302 IPC read with Section 34 IPC.

Heard.

Learned counsel for the petitioner/A.3 submitted that the petitioner has not committed any offence and he is ready to cooperate with the investigation agency. He further submitted that the petitioner is arrested on 16.04.2015 and since then, he has been in prison and as such, prays this Court to grant bail to the petitioner/A.3.

Learned Public Prosecutor submitted that after granting bail, the petitioner could not appear, as a result of which Non-Bailable Warrant was issued to the petitioner, on 26.06.2013, and in execution of NBW, the petitioner was arrested on 16.04.2015, and as such, he requests this Court not to grant bail to the petitioner/A.3.

This Court is of the view that the petitioner absconded nearly one and a half year and as such, it is not a fit case to grant bail to the petitioner/A.3, more particularly, in a serious offence of this nature. Hence, this Court is not inclined to grant bail to the petitioner/A.3.
