Mr. P.R. Prasad, learned counsel for the petitioner, addressed
letter dated 12.08.2015 to the Registry stating that pursuant to the interim order granted by this Court, action has been taken and his client thereupon instructed him to withdraw the writ petition. Ms. Avani Bommineni, learned counsel representing Mr. Avinash Desai, learned counsel for the third and fourth respondents, would however state that though action was taken pursuant to the interim order, the issue is not settled and therefore, the petitioner may not be given the liberty to withdraw the writ petition. However, it is noticed that the interim order granted by this Court was to act as per G.O.Rt.No.50, Higher Education (CE.II) Department, dated 16.01.2001 and proceedings bearing No.2103/Admn.IV.1/2005 dated 23.09.2010.
Therefore, if the third and fourth respondents have any grievance as regards the aforesaid Government Order or the proceedings, they would necessarily have to challenge the same by way of independent proceedings and cannot seek to do so, being respondents, in this writ petition. As the interim order is stated to have been complied with and the same is irreversible, this Court sees no reason to continue with the writ petition when the petitioner seeks to withdraw the same. The writ petition is accordingly dismissed as withdrawn. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
