THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NO.9738 OF 2012 O R D E R:

This writ petition is filed by the petitioner challenging the order, dt.27.03.2012 passed by the first respondent Revenue Divisional Officer, Eluru, West Godavari by cancelling pawn broker licence of the petitioner, on an application made by respondent Nos.2 and 3.

The learned counsel for the petitioner submits that the first respondent has no jurisdiction under Section 20 (1) (b) of Pawn Brokers Act, 2002 (for short 'the Act') to pass the impugned order.

Heard the learned Government Pleader for Revenue appearing for the first respondent and Smt. Anjanadevi Satyanarayana learned counsel appearing for respondent Nos.2 and 3.

A perusal of the impugned order goes to show that there is no finding by the first respondent that there is a contravention as per Section 20 (1) (b) of the Act.

The learned counsel for the respondents submits that the pledged articles were returned by the petitioner. In view of

above facts and circumstances, impugned order, dt.27.03.2012 of the first respondent Revenue Divisional Officer is set aside. The writ petition is, therefore, allowed. Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
