THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.14040 of 2015 ORDER:

This Criminal Petition is filed by the petitioner - accused under Section 438 Cr.P.C. seeking anticipatory bail in Crime No.130 of 2015 on the file of Chittoor I-Town Police Station, Chittoor District, registered for the offences punishable under Sections 302, 307, 120-B and 301 r/w. 511 and r/w.34 IPC and 25-1(b) and 27 of Indian Arms Act. Heard and perused the material available on record. The allegation against the petitioner is that he involved in the commission of murder of Mayor of Chittoor Municipal Corporation Smt. Anuradha and her husband Katari Mohan.

Learned counsel for the petitioner submitted that the name of petitioner was not mentioned in the FIR, but his name was mentioned in the confessional statements of the other accused and that the petitioner is innocent of the offences alleged against him. Learned Public Prosecutor submitted that the investigation is still pending and the involvement of the petitioner in commission of offence is also to be investigated and some more witnesses are yet to be examined.

Considering the above facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.

Accordingly, the Criminal Petition is dismissed. ______________ RAJA ELANGO, J January 20, 2016.
