THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION NO.10381 of 2016 ORDER :

The petitioner, who is A2 in Crime No.166 of 2016 of Arandalpet Police Station, Guntur Urban District, filed the present application under Section 438 Cr.P.C. seeking release in the event of her arrest in connection with the above crime registered for the offences punishable under Sections 420 and 506 of IPC. The case of the prosecution is as under:

The informant and one Bakuru Sunil Kumar, who were real estate businessmen, got acquainted with the accused, who was running a real estate business at different places, invested huge amounts with them believing their deceitful words. It is alleged that when the informant requested to register the properties purchased by them, the accused though took the amount failed to do so and are postponing the matter. Subsequently, on enquiries, the informant came to know that A2 cheated several persons with false information and was also involved in several cases. On 14.06.2016, at about 11.00 p.m., when the accused were present at Omkari Temple, the informant and others approached them and when they asked the accused to return the amounts, the accused are alleged to have threatened them with dire consequences.

Basing on these allegations, the above crime came to be registered. Heard learned counsel for the petitioner and learned Public Prosecutor appearing for the respondent-State. A perusal of the averments in the report would show that the petitioner along with others collected huge amounts of money from the public promising good profits on the investments made in the form

of real estate business.

The informant is alleged to have paid amount of Rs.75 lakhs to the petitioner, who cheated the informant without using the same to the purpose for which it was promised to be used.

Learned public prosecutor, on instructions, states that the petitioner is involved in other cases also.

Having regard to the allegations made, I am not inclined to grant bail to the petitioner.

However, the petitioner, if so advised, shall appear before the trial Court and move an application for grant of bail after giving prior notice to the Public Prosecutor, in which event the same shall be dealt with at the earliest, in accordance with law.
