THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CONTEMPT CASE No.1444 OF 2016 AND WRIT PETITION No.22532 OF 2015 COMMON ORDER:

The contempt case and writ petition are taken up together for disposal in view of the contempt case arising out of the order passed in the writ petition.

The writ petition was filed challenging the action of the respondents in withholding the terminal benefits due to the petitioner on account of the death of the petitioner's husband.

Learned counsel for the respondents submits that all benefits due to the petitioner were paid as on today and the amount due under Staff Retirement Benefit Scheme is under the control of the fifth respondent Society and the petitioner has to approach the said Society for receipt of the said amount and the respondents 1 to 4 have nothing to do with the same. Learned counsel appearing for the fifth respondent submits that the account of the husband of the petitioner was settled on 02.07.2010 on receipt of intimation of death. An amount of Rs.2,14,424/- was due by the deceased towards the loan availed by him while in service and the same was written off and an amount of Rs.1,30,772/- was paid to the petitioner on 07.06.2011. The said amount included interest also.

In view of the above payments, nothing survives for adjudication in the contempt case as well as the writ petition.

The contempt case and the writ petition are accordingly closed. Consequently, miscellaneous petitions, pending if any, in these two cases, shall stand closed. There shall be no order as to costs. __________________________ A.RAMALINGESWARA RAO, J 22.12.2017 pln
