THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.37323 OF 2018 ORDER :
Heard learned counsel for the petitioner and the learned Government Pleaders for Home and Revenue, apart from perusing the entire material on record.
When the matter is taken up, written instructions, dated 24.10.2018, furnished by the Station House Officer, Pentapadu Police Station, West Godavari District, are placed on record by the learned Government Pleader for Home. The said instructions, to the extent of their relevance to the present Writ Petition, read as under: "It is submitted that the crux of the writ petition is that there has been a dispute between the respondents 6 to 8 and the writ petitioner herein. The allegation of the writ petitioner herein is that the respondents 6 to 8 created fake documents and tried to transfer the property belong to the writ petitioner herein on their name. Apart from that, the respondents 6 to 8 obtained loan by mortgaging the said property through the fake document and obtained loan from Mahindra Rural Finance Company.
It is respectfully submitted that the writ petitioner herein alleged that aggrieved by the said illegal actions of the respondents 6 to 8, the writ petitioner herein submitted a compliant dated 11.09.2018 to the respondents 2 to 4 herein for registering the crime against the respondents 6 to 8.
It is submitted that the 4th respondent herein received the complaint dated 11.09.2018 through proper channel, for enquiry and necessary action. After receipt of the said compliant, the 4th respondent herein enquired into the matter and examined four persons and recorded their statements and came to a conclusion that the purview of the issue is under civil nature. Basing on the same, on 13.10.2018, the 4th respondent herein submitted his report to the 2nd respondent herein for closing the said complaint
as No need to take action. Apart from that, on the same day, i.e., on 20.10.2018, the 4th respondent herein sent a letter to the writ petitioner herein by stating all the facts. Copies of the endorsed complaint, statements of the examined persons, Report submitted by the 4th respondent Letter sent to the writ petitioner herein are enclosed here with for kind perusal.
It is submitted that the respondent police never committed any illegality or irregularity as alleged by the writ petitioner herein in not registering the crime against the respondents 6 to 8. I have great respect on the courts and its orders. I will obey the orders if any passed by this Hon'ble Court in connection with the present writ petition". By placing on record the above written instructions, Writ Petition is closed. However, it is open for the petitioner herein to avail the remedies open as per law. There shall be no order as to costs.
