HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 23010 of 2016 ORDER:

Heard learned counsel for the petitioner and Sri N.Praveen Kumar, learned Standing Counsel for the respondent-Municipality. There is no necessity to put the unofficial respondent on notice as this Court is not venturing to adjudicate the issue on merits.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the 1st respondent in not initiating any action for cancellation of permission granted to the 2nd respondent for construction of a house is illegal and arbitrary; and consequently direct the 1st respondent to consider the petitioner's complaint dated 08.09.2016 and legal notice dated 19.09.2015 for cancellation of Permission No.G1/994/2013-2014, TP No.70/2013-2014, dated 22.03.2014.

Though various grounds are raised in the writ petition, learned counsel for the petitioner submits that though the petitioner made a representation dated 08.09.2015 till date no orders are passed and hence seeks a direction to 1st respondent to consider his representation dated 08.09.2015 at the earliest. Learned Standing Counsel for the 1st respondent submits that if the said representation is still pending the same shall be considered in accordance with law.

Without going into the merits of the case and having regard

to the facts and circumstances of the case, the present writ petition is disposed of, directing the 1st respondent to pass orders on the representation dated 08.09.2015 made by the petitioner, in accordance with law, as expeditiously as possible, preferably within a period of one week from today, after hearing the petitioner and the un-official respondent. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
