THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.33638 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the 2nd Respondent to register the crime based upon the complaint Dt. 23-09-2015 which is sent through RPAD and to conduct an enquiry against the 3rd and 4th respondents and their henchmen in order to take action against them by declaring 2nd respondent inaction is being illegal, unwarranted and violation of Articles 14, 21 and 300-A of the Constitution of India."

Heard Sri Ramana Allu, learned counsel for the petitioner and learned Government Pleader for Home for respondents, apart from perusing the material available before this Court. Today, when the matter is called, written instructions, dated 16-10-2015 furnished by the Sub-Inspector of Police, Mylavaram Police Station, Krishna District have been placed on record by the learned Government Pleader for Home and the said instructions read as under:

It is respectfully submitted that one Sani Venkateswarlu the petitioner herein lodged complaint against Vellanki Srinivasa Rao/4th respondent herein stating that he had an extent of Ac.0-22 cents in S.No.119/2003 at Velvadem village through ancestral property from his father and he also purchased 0.04 cents from his cousin brother and made fencing around the said land but the accused and his mother created false documents and registered the land of the petitioner 0.21 cents in his favour, hence requested to take necessary action, the complaint was not signed by the petitioner. Hence again the respondent police take fresh complaint and registered a crime No.187/2015 U/Sec.420, 468 and r/w.34 IPC of Mylavaram P.S. and investigation in to."

On noticing the above said instructions, learned counsel for the petitioner has requested this Court to record the said instructions and dispose of the writ petition. In view of the above, the writ petition stands disposed of, by recording the written instructions, dated 16-10-2015 furnished by the Sub-Inspector of Police, Mylavaram Police Station, Krishna District.

Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
