HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.37327 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the respondents in not converting the petitioner's agricultural land admeasuring Ac.6.39 gts situated at Sy.No.278 of Burhanpuram Villaoge, Khammam Urban Mandal, Khammam District, into non agricultural purpose under the A.P. Agricultural Land (Conversion for Non-Agricultural Purpose) Act, 2006 (for short, "the Act") as illegal and arbitrary.

Learned counsel for the petitioner submits that though the petitioner submitted an application on 20.02.2018 seeking conversion of the subject land into non agricultural purpose under the provisions of the Act, the 4th respondent, did not take any action so far. When the matter is taken up for hearing, learned Government Pleader for Revenue would submit that the 4th respondent may be directed to pass appropriate orders on the application of the petitioner in accordance with law.

Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 4th respondent-Tahsildar, to deal with the application submitted by the petitioner on 20.02.2018, seeking conversion of the land into non agricultural purpose under the provisions of the Act and pass appropriate orders, as early as possible preferably, within a period of three to four months from the date of receipt of copy of this order, in accordance with law, after giving the reasonable opportunity of hearing to the petitioner and all concerned.

With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
