ORDER
This Criminal Petition is filed under Section 482 Cr.P.C. to quash the proceedings in C.C.No.447 of 2014 on the file of Judicial Magistrate of First Class at Manthani.
2. Heard learned counsel for the petitioner and learned Additional Public Prosecutor representing the State.
3. A prima facie reading of the charge sheet discloses that the investigating officer found that there is no material against the petitioner/accused for prosecuting him. The last para of the charge sheet read as under:
" More over, the complaint lodged with a delay of (8) years, and the accused had been working in the same department at Peddapalli, after completion of departmental enquiry. The accused neither misused the amount not misappropriated the amount. The complainant had been lodged with statistical purpose and shift the burden. The LW-2 to LW-8 were the witness to this incident."
4. A bare reading of the above contents clearly show that there is no material to proceed against the accused.
5. In that view of the matter, the Criminal Petition is allowed and the proceedings in C.C.No.447 of 2014 on the file of Judicial Magistrate of First Class at Manthani, are quashed against the petitioner/accused.
6. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
